GITMO and Habeas Corpus

Last Saturday, in the quaint village of AustinShire, Texas, a number of panels discussed some pretty heady and nasty topics. Among the worst was a panel made up of Vince Warren, Jameel Jaffer, Dahlia Lithwick, and Jeremy Scahill. They discussed Gitmo, the attack on Habeas Corpus, the eradication of the US Constitution, and together, they painted a dreary picture about what America has done to innocents, citizens of other countries, and more…


At some point in time, Crooks and Liars, C-SPAN, or other outlets will have the video of this conference. When it pops up, I will edit this and add that information.


Watch the conference. Get as angry and worried and uncomfortable, even mad as hell as the rest of the audience did last week. The idea that America has sunk to such depths is still jaw-dropping.


The point every speaker made was this: We should not seek the impeachment or trial of Bush, Cheney, Rumsfeld or others as a form of retribution, as a political weapon, or just because we feel like it. Not only would it be counter-productive, it might even create sympathy for those criminals.


To the contrary, we MUST seek impeachment and war crimes trials for an entirely different reason. They broke the law, US law, international, and many treaties, conventions and statutes. If I murder someone, the chances of my going to trial are pretty good, even if we elect a new State's attorney, governor, or even president. Why? Because I broke the law, and I am responsible for my crimes, regardless of who wins those offices. That same standard applies to the president and his top aides. They broke the law, and they must suffer the consequences. If we fail to uphold the law and prosecute now, then 200+ years of American jurisprudence, of the rule of law, and of what makes America so special will be tossed out as being inconvenient or hard.


America is better than that. I hope.

Senator Obama has told voters over and over, throughout this campaign and throughout his political career that it is our job to hold him and other politicians accountable.


As Obama travels abroad in Israel, Palestine, Iraq, Afghanistan and Europe, it is time for the anti-war movement to hold Obama accountable. Early in the campaign Obama made an important promise that we should hold him to, he said:

As he meets with foreign leaders, particularly in the Middle East and Afghanistan, we need to let him know that peace voters expect him to live up to that pledge.

Sen. Obama: It is time to work to "end the mindset" of war.


In recent comments you have urged voters to "hold you accountable" and make policy demands on you. On January 31, 2008 you said "I want to end the mindset that got us into war in the first place." This is the standard we urge you live-up to - the statement for which we write to hold you accountable.


As you embark on your tour of Europe, the Middle East and Afghanistan as the putative Democratic nominee it is time to begin to "end the mindset" of war. When you visit Israel urge them do not bomb Iran; tell the Israelis and Palestinians that peace is the priority; urge U.S. commanders in Iraq to speed up the withdrawal you have proposed and make it a complete withdrawal - do not leave a residual force, mercenaries, a strike force in Kuwait or any long-term bases, and when you are in Afghanistan emphasize non-military solutions to the conflict there. Militarism dominates U.S. statecraft. It is time for greater emphasis on negotiation, diplomacy, multi-lateralism and foreign aid.


Your recent writings and speeches on Iraq indicate that you have not backtracked. It is critical that you do not do so. Already many in the peace movement are concerned with some of your positions particularly the incomplete withdrawal that leaves tens of thousands of residual forces in Iraq, leaves more than 100,000 private military forces (mercenaries) and creates a combat strike force in Kuwait while continuing to threaten Iran. Do Not Take Americans Opposed To War For Granted. Anti-war voters - the majority of Americans - have many options. We do not have to donate time or money to your campaign, we can vote for clearly anti-war third party and independent candidates or we cannot vote at all.


War is not the answer to any of these conflicts. The U.S. is not made more secure by creating new enemies and draining our treasury. The U.S. military budget is sapping the economic strength of the nation and making it impossible to face up to the urgent needs of a new energy economy, upgraded infrastructure, health care for all and other necessities of the American people. When you "end the mindset" that led to the Iraq War it will allow for a re-prioritization of resources at home and abroad away from a military economy toward a civilian one.

Campaign Cash Flows to Pelosi’s Republican Opponent Despite Difficult Odds

Running against Speaker Nancy Pelosi in her home district in San Francisco is as close to a political suicide mission as a Republican can undertake — but unlike her underfunded predecessors, GOP nominee Dana Walsh won’t lack for money.


Walsh, an interior designer and member of the San Francisco GOP central committee, had raised $363,871 as of June 30, according to CQ money line. Her campaign had $45,168 on hand, with the report showing that most of the money raised went toward the cost of setting up a national direct-mail fund raising operation.


Her campaign consultant, California GOP veteran Harvey Hukari, said the campaign aims to raise almost $1 million before the Nov. 4 election in California’s 8th District. With that money, he estimated Walsh will have enough money to run a direct-mail and cable TV ad campaign.


Such a big dollar figure represents a major change for a GOP nominee against Pelosi, who since her first election to the House in 1987 has been re-elected to 10 full terms with an average of 81 percent of the vote.


Pelosi’s 2006 GOP opponent, Mike DeNunzio, reported raising $149,842 for his campaign against the Democrat; he received 10.7 percent of the vote.


A complicating factor in November could be the potential candidacy of anti-war activist Cindy Sheehan, who has to collect more than 10,000 voters’ signatures by Aug. 8 to win a place on the ballot as an independent. Her second-quarter report was not available from the Federal Election Commission.


The high profiles of Pelosi and Sheehan have helped Walsh raise funds, according to Walsh and Hukari. “I’m running against two of the most dangerous women in America,’’ Walsh says on her campaign Web site.


Pelosi, long one of the House’s most prodigious fundraisers, reported that her Nancy Pelosi for Congress campaign took in $2.4 million through June 30. It had $455,138 on hand. Some $1.4 million of the money raised was donated by the Speaker to Democrats seeking House seats.


Walsh said she knows the odds against her are long. “It’s a two-party system. Someone has to run,’’ she said.


She describes herself as a San Francisco Republican of libertarian bent on some issues. But her platform calls for no pullout from Iraq, a halt to illegal immigration and energy independence, which she says should include allowing oil drilling on Alaska’s North Slope — all unpopular positions in the district.


The 8th Congressional District, which includes most of San Francisco, is home to many wealthy GOP contributors, but with Democrats enjoying a 6-to-1 registration edge over Republicans and the Speaker as a neighbor, many have shied away from the Walsh campaign, Hukari said.


According to a CQ MoneyLine analysis of contributors who identified where they lived, the second-quarter campaign finance reports showed that 27 percent of Walsh’s money came from within California.


That analysis also showed Pelosi receiving 47 percent of her campaign contributions from within California; much of that money came from within San Francisco.


FISA FIGHT-BACK: Many supporters of Barack Obama were outraged by his decision to back the recent White House surveillance bill (FISA), so they took over his website. To its credit, the Obama campaign runs the most open online platform of any major presidential candidate. Visitors may post criticism of the candidate--an act that was restricted on HillaryClinton.com--or use networking tools to build protest groups. Activists did just that by creating Please Vote NO on Telecom Immunity--Get FISA Right, which swiftly became the largest network on Obama's site, topping even the campaign's official groups. After whipping up the blogosphere, the group drew coverage from TheNation.com, newspapers and TV.


Then Obama responded directly. In an unusually long online letter, Obama said he still opposed immunity but supported the bill to modernize surveillance oversight and pursue "accountability" via future investigations. Activists welcomed the reply but rejected the substance. Many are continuing the fight at a new hub, getfisaright.com, which organizes Obama supporters around civil liberties. A related coalition, accountabilitynowpac.com, is coordinating a fundraising drive on August 8, the anniversary of the announcement of Richard Nixon's resignation, to mobilize against the "key enablers of the tyrannical and lawless FISA 'compromise.



If Obama is lucky, he'll continue to benefit from activists who support his candidacy but also intend to press him on key issues, using his campaign's tools to organize for causes beyond his election. The protest group replied to Obama's letter by heralding this collective dynamic. "As you have said time and again Senator, 'we are the ones we have been waiting for,' and we are here, working to bring about real change in Washington."
